NRC rule lets applicants lean on DOE and DOW test data; Antares says Mark-1 cleared its first DOE gate

Shift turnoverThe short version

  • No watchlist item met the alert threshold Fri Oct 23 through Mon Oct 26.
  • The NRC's final rule on reusing DOE and Department of War (DOW) reactor data appeared in the Federal Register on Oct 26; it takes effect Nov 25, 2026.
  • Antares says DOE approved the Mark-1 NSDA. That is the first DOE authorization gate, not a permit to operate, and it is logged as a pending promise.
  • NRC holds its second licensing-pathways workshop on Wednesday, Oct 28.

NRC final rule: reactor designs previously authorized by DOE or DOW

Condition
Final rule signed Oct 22, 2026 and announced that day (NRC news release 26-081); published in the Federal Register Oct 26, 2026 (91 FR 67195, FR Doc. 2026-21801).
Required action
Effective Nov 25, 2026. New §50.43(f) and revised §53.440(a)(1) let a commercial applicant reference information from a reactor that DOE or DOW authorized, tested and showed to function safely.

The rule text keeps the burden on the applicant: it must show how the prior authorization satisfies NRC requirements and address any differences in design, site, hazards or safety assumptions. The NRC says the rule does not delegate its review to DOE or DOW and does not change the §50.43(e) safety standard. It drew 136 unique comment submissions.

Watch forCompanies describing a DOE-track criticality as an NRC shortcut. Under this rule, DOE data can narrow the NRC's review; they do not replace it.

Antares Mark-1: company says DOE approved its NSDA

In an Oct 23 release, Antares says DOE approved the Mark-1 Nuclear Safety Design Agreement (NSDA). The company targets several months at full electrical power at INL in 2027 and Army Janus deliveries at Fort Bragg from 2028. The NSDA is the first DOE authorization step; the preliminary and final safety analyses (PDSA, DSA) are still ahead. For scale, Antares's Mark-0 went from NSDA to zero-power criticality in about eight months.

Watch forGrade C: a company release. Logged as a new pending row in the Promise Ledger (made Oct 23, 2026; targets 2027 and 2028). The row will be updated, not rewritten, as dates hold or move.
